Privacy and PDPA Policy

This Privacy and Personal Data Protection Policy Notice is issued by and on behalf of Jesselton International Sdn Bhd. (Company Registration No. 201001023716-H) (“Company” or “Jesselton International”) and its subsidiary companies (collectively known as “Jesselton International Group” or “the Group”) pursuant to the Personal Data Protection Act 2010 (“Act”) (“Privacy Notice”).

Personal Data Collected
In the course of your dealings with the Jesselton International Group, we have collected and/or will be collecting Data and information about yourself (“Personal Data”) to enable us to enter into the commercial transaction or to deliver the services or products depending on the purpose for which you disclosed the data.

Personal Data
Such personal data may be subject to applicable data protection, privacy and other similar laws and may include but not limited to the following: - name, date of birth, gender, race, NRIC / passport no., marital status, your contact information, educational, professional, occupational, financial, familial details and criminal history, where permitted by applicable law and/or any other current or past information as requested which you may provide to us. Some of your personal data may also have been obtained by us from public records, media publications and/or third parties legally authorized (at the time of disclosure) to disclose such data.

Purpose and Disclosure
Your Personal Data is being or will be processed for the purposes for which it was disclosed by you, such as to enable us to consider entering into a contract with you, to fulfil our contractual obligations to you and/or to offer or to deliver our products and/or services to you including delivery of marketing materials for such products and services offered by the Group. In addition, your Data is also being processed or will be processed to enable us to better administer our contractual relationship and/or to provide you with information on Jesselton Waterfront Holdings Sdn. Bhd., our activities, products and/or services and any other purposes relating hereto (“Purposes”).

For the Purposes, your Personal Data may be disclosed to but not limited to other departments of the Company, another or affiliated company within the Jesselton International Group or to our agents, representatives, business partners, professional advisors and/or consultants, third party service and/or utility providers, contractors, suppliers and/or vendors as well as to relevant governmental, municipal and/or regulatory authorities and any other parties as may deem necessary by us to fulfil the Purposes as mentioned above.

Language
In accordance to Section 7(3) Personal Data Protection Act 2010, this Policy is issued in both Bahasa Malaysia and English languages. In the event of any inconsistency, the English language version of this Policy shall prevail.

Consent and Choice
Save for Personal Data necessary for the performance of contracts between us (for which you must provide the Data failing which you may be in breach of contract and/or we may not be able to contract with or fulfill our contractual obligation to you), you may choose whether or not to provide your Data and (if already provided) may choose whether or not to consent, or to withdraw or limit your consent, in full or in part, for your Data to be collected and/or processed as above.

Access, Correction, Objection to Processing, and Data Portability
You have the right to request for access to your Personal Data for purposes of updating or correction of information and to request for a copy of the information in an intelligible format, to be provided to you or transmitted directly to another data user feasibly or as lawfully permitted.

You may at any time, by written notice, to request the Company to cease or prevent the initiation of processing of your personal data for purpose of direct marketing or if such processing is likely to cause substantial damage or distress to you or another person, and such damage or distress would be unwarranted. In any event of a personal data breach that is likely to result in significant harm to you, the Company shall notify the Personal Data Protection Commissioner as soon as practicable, and where required, to notify you of such breach with sufficient information to allow you to take protective measures.
